Expert witness reports for property disputes

Independent technical and valuation evidence for selected residential property disputes. We agree the issues to be addressed, the evidence needed and the reporting requirements before accepting an instruction.

Disputes we can assist with

We consider instructions from solicitors, property owners and other parties who need an independent opinion on building condition or residential property value. The scope depends on the questions in dispute and the evidence available.

Japanese knotweed diminution in value

We assess the effect of Japanese knotweed on residential property value, considering the relevant date, market evidence and specialist information about its extent and treatment. Treatment costs and any remaining effect on value are considered separately.

Housing disrepair and landlord and tenant disputes

Inspection and technical reporting on alleged residential disrepair, including damp, water ingress and defects affecting the building’s fabric. Where the instruction concerns Section 11 of the Landlord and Tenant Act 1985, the report can address the condition of the structure, exterior and relevant installations within the agreed scope.

We explain our findings, the evidence supporting them and any limitations. The application of the law and questions of legal liability remain for the parties’ legal advisers and the court.

Residential valuation disputes

Independent evidence where the market value of a residential property, or an alleged reduction in value, is disputed. We agree the valuation date, basis and assumptions, then explain the market evidence and reasoning supporting our opinion.

What the report addresses

The report identifies the questions we have been instructed to consider, the documents reviewed and any inspection undertaken. It distinguishes observations from assumptions, explains the reasoning behind the opinion and records material limitations or further information needed.

Arranging an instruction

Send the property address, a short summary of the dispute, the parties involved, any relevant valuation dates and the reporting deadline. Tell us whether proceedings are proposed or underway. We check suitability and conflicts before agreeing the scope, fee and programme; detailed case papers can then be provided through the route agreed with the office.
